How to draft a contract

Edited

In this article, we'll look at drafting a contract and some best practices around this.

Drafting a contract should be simple and follow naturally after we have a conversation with an influencer we matched with.

Before reading this article, we recommend reading the Next steps after a match article to better understand the process.

The following details are included in the contract:

  1. Collaboration payment

  2. Collaboration type

  3. Fee (for paid collaborations)

  4. Deadline to post content

  5. Deliverables

Let's have a look over each one:

  1. Collaboration payment πŸ’΅

The collaboration payment refers to the payment influencers receive for this campaign. Depending on the campaign setup, this can be gifted, paid, or affiliated.

For example, if you're running a gifted campaign, then all the collaborations for this campaign should be gifted, and therefore all the contracts you draft should be gifted.

This is what the payment section of the contract looks like:

Best practiceβ€”In general, we recommend keeping the collaboration payment matching the campaign type. If you have a gifted campaign, avoid entering into different agreements with influencers for paid or affiliate collaborations.

In general, all the applications coming should be for gifted collaborations, but from time to time, we might have influencers who apply with gifted and then want to switch this to a paid collaboration. In case something like this occurs, simply let them know you cannot do this and then replace the collaboration.

Exceptions can be made: if you have an influencer you really want to work with but might want to do a paid collaboration, you can accept and go on. The same applies to affiliates.

This is more of a general practice, and we recommend sticking to it, but if you really want to work with an influencer you like and do not want to miss the opportunity, go ahead.

  2. Collaboration type πŸ†Ž

The collaboration type refers to the deliverable or the placement of this collaboration - is it an Instagram story, a reel, or a feed post?

This depends on the way you set up the campaign and what the influencer applied.

Please make sure to select all the options you agree with the creator on. In general, it should be just one, but if you agree on more, please make sure to select them here.

All the collaboration types should be agreed upon with the influencer before.

  3. Fee πŸ’°

This only applies to paid collaborations. The fee must be mentioned here.

  4. Deadline βŒ›

The deadline to post the content is discussed and agreed upon with the influencer, and it also depends on their time situation.

We advise giving influencers up to 14 days to create content, depending on the complexity of the collaboration. For example, if you have multiple deliverables or a longer reel, that might take a bit of time, especially since influencers have other commitments as well.

Be flexible, give them a bit of time, and then mention the deadline in the contract. Obviously, you'll agree and communicate with them about this.

  5. Deliverables πŸ“œ

Deliverables - This is an open section, and we recommend a few things here:

    • Insert how many deliverables you get - is it one reel, two reels, or one reel and a feed post? Make sure to mention the amount here.

    • Important pointers like - things the influencer is not allowed to say or anything similar to that. The idea here is to mention all the other important details that you think are relevant.
